Terms of Service

1. Acceptance of Terms
By accessing or using the Stay mobile application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not access or use the Service.
2. Description of Service
The Stay mobile application is a technology platform and marketplace that connects tenants with landlords in Zimbabwe. We provide a platform for listing, discovering, and requesting to book rental properties. Stay does not own, manage, or control any properties listed on the platform. Stay is not a landlord, rental agent, or property manager. Stay is not responsible for the accuracy, quality, or legality of listings posted by landlords.
3. User Accounts
You must create an account in the Stay mobile application to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration.
4. Listing Properties
Landlords who list properties on Stay represent that they have the legal right to rent the property. All listing information, including photos, descriptions, and pricing, must be accurate and up to date. By listing on Stay, landlords confirm their property complies with all applicable Zimbabwe Tourism Authority (ZTA) regulations where required. Short-term rentals under 30 days may require ZTA registration. Stay reserves the right to remove any listing that violates these Terms or our Community Guidelines.
5. Bookings and Payments
All booking requests made through Stay are agreements between tenants and landlords. Stay facilitates the booking process but is not a party to the rental agreement. Disputes between hosts and guests are handled between parties. Stay is not responsible for resolving disputes, though we may offer guidance where appropriate. Landlords are responsible for declaring rental income to ZIMRA in accordance with Zimbabwe tax law. Stay does not provide tax advice. In-app payments are not currently available — tenants and landlords coordinate payments directly.
6. Prohibited Activities
Users may not: post false, misleading, or fraudulent listings; harass, abuse, or discriminate against other users; use the Service for any illegal purpose; attempt to circumvent Stay's payment system; scrape, copy, or redistribute content from the Service without permission.
7. Intellectual Property
All content, features, and functionality of the Service are owned by Stay and are protected by international copyright, trademark, and other intellectual property laws. Users retain ownership of content they submit but grant Stay a license to use, display, and distribute that content on the platform.
8. Limitation of Liability
Stay provides the Service "as is" without warranties of any kind. We are not liable for any disputes between tenants and landlords, property conditions, or losses arising from the use of our Service. Our total liability is limited to the fees you have paid to Stay in the preceding 12 months.
9. Account Deletion and Termination
We may terminate or suspend your account at any time for violations of these Terms. You may request deletion of your account and all associated data at any time via the Delete Account option in the mobile application or by contacting support. Deletion requests are processed within 30 days, during which you may cancel the request. Upon termination, your right to use the Service ceases immediately.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the mobile application or via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of Zimbabwe. Any disputes arising from these Terms or the Service shall be resolved in the courts of Zimbabwe.
